    this pop star for the selfie generation      I hate stuff like this, it sounds disrespectful and judgmental like they can't make an objective professional review without finding sneaky ways to look down at her, despite the high rating. This is why I got into Lana, people are weirdly ashamed of liking a record so they try to find other ways to tell people they are self aware.

    I don't understand what grounds are Radiohead calling for them to claim 100% of a song and refuse all settlement even though it means going to court. Because like other people said in this thread they don't have much going for them, they even got sued for the same song and lost. I understand that there's a similarity in the chord progression but I thought that Lana and her team being American (and from a major label) had it covered somehow. 
     
    I know RH comes off bad and greedy in this narrative but I'm really not looking forward having hateful old men and prissy hipsters comment on lana videos, and I don't think Lana has taken it lightly. Even if RH gets a small percentage of credit they will benefit from the increase in stream and interest which is bothersome theoretically but what is worse they have managed to attach bitterness to a song that was about looking for an alternative to darkness and dared to be hopeful.

    As much as I love Ultraviolence as an album, I find it really hard to listen to the song UV, especially after LFL has been released.
    I think seeing the way Lana was during the HM era and now, it really puts the UV era into perspective for me.
     
    Whenever I listen to UV (the song) it just reminds me of how depressed and sad she was during that time.
    Even reading interviews from the time just feels like it's not Lana, and it makes me so sad to see how sad she was. 
    I really appreciate and love who Lana is now, and I'm glad she is happy within herself, or is at least striving towards that.
     
    I know the last part about Lana's happiness isn't unpopular, but I thought maybe not being able to listen to UV anymore was. Not sure, let me know if anyone else feels this way.

    The "I wish I was dead already" comment she made to the Guardian reporter, followed by the cancellation of multiple performances and appearances due to "mystery illness," which she told the Fader in May 2014 was the reason she became depressed. 
     
    I'm sure there are other factors that we don't know about, as Lana is not one to divulge any details private matters, which I completely respect.

    Personally the amount of bs thrown at her made me legit scared for personal safety at a point for a minute, the amount of negativity thrown her way was excessive and inhumane

    Yes, there were some things you included that I didn't write in my response to @@white gold but I really do believe she was depressed, and that's why I can't fully enjoy the darker tracks associated with that era.

    If Lana copied the exact chord progressions, Radiohead would have every right to sue her.
     
    In this case, the claims are only based on both songs being somehow similar. This circumstance makes the case even sadder considering that artists are trying to limit other artists in their artistic freedom.
     
    Also, the fact that she even tried to offer up to 40% speaks for her not wanting to fight over music.
     
    Can’t wait to see her win and expose these money hungry, untalented asses.

    Get a paper, write 'Creep' on it. With a red marker.
    Get your cauldron with hot water. Put rosemary & thyme and some ruined peaches and then put the paper that has 'Creep' on it.
    Then chant the chorus of Get Free while you stream it on Spotify.
     
    Oh, and only black outfits are allowed.

    long analysis below.
     
     
    no one song owns 100% of the rights to its chord progression. as far as the creep progression goes, it's far from groundbreaking, it's just a natural voice leading progression on the guitar. anyone arrogant enough to think they invented a chord progression knows nothing about writing music. as far as melody goes, they're only similar in the way that they both sing notes in the scale. 
     
    the creep progression is G - B - C - Cm
    get free (i should mention, only in its verses and prechoruses) is Bb - D - Eb - Ebm (once it gets to the chorus it's Bb - Gm - Bb - Gm - Bb - C - Bb - C)
     
    so they're not even in the same key, they just use the same harmonic progression. but again, who would be arrogant enough to think they own 100% of the rights to that progression? the use of secondary chords can be traced back to the fucking baroque period. 
     
    as far as copyright infringement goes, even if it is decided that lana was inspired by creep for the song, the purpose and character of the work is transformative. they are her own lyrics, a very natural melody over those chords if it is decided that it's similar to creep, and completely different instrumentation. even getting 40% of the publishing for get free would be incredibly generous of lana to do, because legally, there's no reason that the songs share any striking similarities compositionally that either party could argue that they "own". lana does not sample creep, she barely even interpolates it. 
     
    and even on top of all of this, there's NO logical reason to ask for 100% of the publishing rights on Get Free because they don't fucking own 100% of Creep. After they were sued by the Hollies and lost, Albert Hammond and Mike Hazlewood were given (and still have to this day) writing credits on Creep. they split the royalties.
     
    this is just ridiculous to me, and i'm pretty sure radiohead is going to lose this case, bigtime.

    Okay so as some of you know, I'm studying to be a lawyer and this is what I know:
     
    Chord progressions are not protected under the law because they are generally universal products and easy to copy -- it's like if Hershey or Toblerone said that they were the only manufacturers allowed to make chocolate. Radiohead can't sue based on chord progressions. Musical theorists have a saying that "everything is a remix." It's impossible to make a song that has no echo of a past song. The legal standard for copyright infringement is "substantial similarity" which is a relatively hard test to prove. Radiohead's attorneys need to prove that the songs are substantially similar in order to win, if they are going for copyright infringement, which is a lot harder than just proving that the songs are "similar." "Substantial" is the key word. Wasn't Radiohead sued by The Hollies for this song? And they lost? If so, this gives them very unsteady legal ground to stand on. I'll update as I think of more.
     
    Update: also, intent doesn't matter much in the context of copyright infringement; whether Lana/Nowels etc. intended (meant) to copy Creep is irrelevant. If the court finds that she did, in fact, copy the song then it won't matter if it was a mistake or not.

    I mean, 40% is a LOT. Of course not as much as 100%, but believing that they would get that is not realistic. Lana was kind enough for offering 40, let's see how this ends. I'm hoping Lana will come out of this as the winner, or at least feeling pleased with the results.

    I’m glad that she’s taking the lead and confirming it herself. That’s not good for Radiohead’s image.
     
    What I’m not happy about is that some of the comments by Lana stans on instagram or Twitter are... pretty childish.

    Like, they didn't listen to the song and thought "Wow, this sad woman is finally seeing the light at the end of the tunnel... maybe we shouldn't be so harsh to her".

    Honestly already imagining what the next album is gonna be like with all this drama going on in Lana's life right now... but on a serious note, I pray our baby girl does well in court. We all know too well how Lana's struggled and fought hard for credibility and respect as an artist since her debut.... this is such a low blow by Radiohead too.
