Okay so as some of you know, I'm studying to be a lawyer and this is what I know:
 
Chord progressions are not protected under the law because they are generally universal products and easy to copy -- it's like if Hershey or Toblerone said that they were the only manufacturers allowed to make chocolate. Radiohead can't sue based on chord progressions. Musical theorists have a saying that "everything is a remix." It's impossible to make a song that has no echo of a past song. The legal standard for copyright infringement is "substantial similarity" which is a relatively hard test to prove. Radiohead's attorneys need to prove that the songs are substantially similar in order to win, if they are going for copyright infringement, which is a lot harder than just proving that the songs are "similar." "Substantial" is the key word. Wasn't Radiohead sued by The Hollies for this song? And they lost? If so, this gives them very unsteady legal ground to stand on. I'll update as I think of more.
 
Update: also, intent doesn't matter much in the context of copyright infringement; whether Lana/Nowels etc. intended (meant) to copy Creep is irrelevant. If the court finds that she did, in fact, copy the song then it won't matter if it was a mistake or not.

I think this all plays into a very sad, recent trend of older musicians filing frivolous lawsuits against younger, current musicians. It's been happening so much recently and I think it's really discouraging to see how desperate and vicious older acts are when the opportunity to monetize. Current artists grow up listening to these songs and it's only natural that some of that would come out in certain melodies that sound similar. Thom Yorke is extremely financially secure, in no way does he need (nor deserve) 100%. I think it's such a dangerous artistic prescient to be setting restricting artistic expression.

I’m glad that she’s taking the lead and confirming it herself. That’s not good for Radiohead’s image.
 
What I’m not happy about is that some of the comments by Lana stans on instagram or Twitter are... pretty childish.

Imagine being that talented that some old guys try to get their piece of cake just because a few chords sound similar.

Like, they didn't listen to the song and thought "Wow, this sad woman is finally seeing the light at the end of the tunnel... maybe we shouldn't be so harsh to her".

IM SO MAD because this song is so personal and private to her, and she only wanted her fans to know about it. But now it's being taken to court and its making headlines, its so disrespectful to the song and to her music. Its about her trying to be positive and now it just has such a negative back story. Honestly already imagining what the next album is gonna be like with all this drama going on in Lana's life right now... but on a serious note, I pray our baby girl does well in court. We all know too well how Lana's struggled and fought hard for credibility and respect as an artist since her debut.... this is such a low blow by Radiohead too.

I agree that the melody is similar BUT is only for like a 20 second part and is just a similar chord progression..it's not like it was all plagiated. So Lana's offer of 40% was enough.
Their demand of 100% is just absurd and unacceptable    

Here's the thing: The similarities aren't that noticeable unless someone points it out. I've listened to Creep a thousand times and when I first heard Get Free, I didn't even notice. Sure, the chord progressions are very similar but overall, Get Free sounds entirely different at the same time.
I think this is just Radiohead trying to weave their way back into the spotlight, wether it be by releasing a new album or going so far as to take Lana to court. It's pretty petty if you ask me.

They could have compromised with 40% which Lana so benevolently offered to them. They will lose the case for sure. They don't deserve even 1%. Bloody Greedy Motherfuckers

All the comments that I’ve read about this on Facebook and the articles reporting on it are generally saying that Radiohead is being extra. There are definitely similarities in the two tracks, but I think not accepting 40% of the royalties looks worse on them than Get Free using the same chord progression as Creep. I don’t think it’s bad publicity for Lana at all. Radiohead is coming off as huge douchebags to the general public. Not that that’s anything new for them anyway lol.

Lana is a musical genius, she probably did this on purpose. Radioblowjob should consider themselves lucky to even be in the same news article as Legend Del Rey.

I thought Lana admitted the melody was an homage to Creep?! When the album came out. Maybe she should have given them credit on the album but I thought this was all done in the open and on purpose.
