    I highly doubt the court will give radiohead 100% and Lana is aware of this. She wouldn't tweet about this if she wasn't sure she would have a favorable outcome. I think she tweeted that to be petty so that EVERYONE is aware when Radiohead doesn't get 100%. She is very upset--clearly

    long analysis below.
     
     
    no one song owns 100% of the rights to its chord progression. as far as the creep progression goes, it's far from groundbreaking, it's just a natural voice leading progression on the guitar. anyone arrogant enough to think they invented a chord progression knows nothing about writing music. as far as melody goes, they're only similar in the way that they both sing notes in the scale. 
     
    the creep progression is G - B - C - Cm
    get free (i should mention, only in its verses and prechoruses) is Bb - D - Eb - Ebm (once it gets to the chorus it's Bb - Gm - Bb - Gm - Bb - C - Bb - C)
     
    so they're not even in the same key, they just use the same harmonic progression. but again, who would be arrogant enough to think they own 100% of the rights to that progression? the use of secondary chords can be traced back to the fucking baroque period. 
     
    as far as copyright infringement goes, even if it is decided that lana was inspired by creep for the song, the purpose and character of the work is transformative. they are her own lyrics, a very natural melody over those chords if it is decided that it's similar to creep, and completely different instrumentation. even getting 40% of the publishing for get free would be incredibly generous of lana to do, because legally, there's no reason that the songs share any striking similarities compositionally that either party could argue that they "own". lana does not sample creep, she barely even interpolates it. 
     
    and even on top of all of this, there's NO logical reason to ask for 100% of the publishing rights on Get Free because they don't fucking own 100% of Creep. After they were sued by the Hollies and lost, Albert Hammond and Mike Hazlewood were given (and still have to this day) writing credits on Creep. they split the royalties.
     
    this is just ridiculous to me, and i'm pretty sure radiohead is going to lose this case, bigtime.

    Okay so as some of you know, I'm studying to be a lawyer and this is what I know:
     
    Chord progressions are not protected under the law because they are generally universal products and easy to copy -- it's like if Hershey or Toblerone said that they were the only manufacturers allowed to make chocolate. Radiohead can't sue based on chord progressions. Musical theorists have a saying that "everything is a remix." It's impossible to make a song that has no echo of a past song. The legal standard for copyright infringement is "substantial similarity" which is a relatively hard test to prove. Radiohead's attorneys need to prove that the songs are substantially similar in order to win, if they are going for copyright infringement, which is a lot harder than just proving that the songs are "similar." "Substantial" is the key word. Wasn't Radiohead sued by The Hollies for this song? And they lost? If so, this gives them very unsteady legal ground to stand on. I'll update as I think of more.
     
    Update: also, intent doesn't matter much in the context of copyright infringement; whether Lana/Nowels etc. intended (meant) to copy Creep is irrelevant. If the court finds that she did, in fact, copy the song then it won't matter if it was a mistake or not.

    I think this all plays into a very sad, recent trend of older musicians filing frivolous lawsuits against younger, current musicians. It's been happening so much recently and I think it's really discouraging to see how desperate and vicious older acts are when the opportunity to monetize. Current artists grow up listening to these songs and it's only natural that some of that would come out in certain melodies that sound similar. Thom Yorke is extremely financially secure, in no way does he need (nor deserve) 100%. I think it's such a dangerous artistic prescient to be setting restricting artistic expression.

    Now that 2017 has come to a close and 2018 has begun, I thought it would be fun to reflect on some of our favourite Lana looks of 2017! Because I'm extra, I chose a top 25, with 1 being my most favourite & so on. I put photos in the spoiler so it doesn't clog up the thread. 
    I'm interested to see what looks of Lana's you all enjoyed the most from 2017!
     
     
     
    1. April 20 - Dazed Magazine
    The date isn't accurate since we don't know when the photoshoot was, but I just put the date of the magazine release. This is definitely my favourite look of 2017 (as evident by the site theme) Her hair was glorious. Very BTD-esque. Her makeup looked great here too. All of the shots from this photoshoot were amazing.
     
     
     
    2. May 3rd - V Magazine
    The iconic bouffant! I was so excited to see it return. Her makeup was absolutely stunning too. One of her best looks, ever.
     
     
       
    3. August 12 - Way Out West Festival
    Again, love her hair. The dress also remind me of the vintage dresses she would wear during her 2014 American leg of the Paradise tour. I ended up snagging this dress for myself too.
     
     
     
    4. August 11 - Flow Fest
    I know a lot of people weren't crazy about this look, but I really loved it. I thought the skirt was super cute and thought it was trendy that she paired it with an oversized sweatshirt (even if it is Adidas.) Also, the red flower in her hair paired with her berry lip completely make the outfit.
     
     
     
    5. May 11 - on Instagram
    I wish we had pictures from this day since this was just from her Instagram story, but OH MY GOD this post will forever be an iconic video. Her beachy hair and her natural beauty are incredible.
     
     
     
    6. September 8 - Santa Barbara Bowl
    This dress was super cute. Her hair was gorgeous as well. She was very smiley this day, and everyone knows that a smile is one's best accessory.
     
     
     
    7. August 1 - House of Blues, Anaheim
    Out of all the black long sleeved shirt & jeans looks she did this year, this one was the best executed. The shoes were super cute (I just bought a pair for myself the other day) and the flower in her hair is everything. I also love the soft waves in her hair on this day. Kudos to Anne!
     
     
     
    8. July 26 - Amoeba
    This was my second favourite black&jeans look of the year. I'm not sure if it was just because she was at Amoeba again or what, but she truly looked straight out of 2011/2012. Her face looked so young here - I'm thinking a pairing between her makeup this day and, again, how smiley she was. I also liked how her hair was pulled back out of her pretty face.
     
     
     
    9. December 17 - Melrose Trading Post
    I feel like this will be a popular favourite. Despite another repeat outfit, her hair looked so gorgeous this day not terribly long after the big chop & her eyelashes are INCREDIBLE! I'm calling Pammy up right now to see what lashes she has Lana using.
     
     
     
    10. July 24 - Candid in London
    I remember seeing this photo and thinking it could have easily been straight out of July 2012. Her face and her hair scream BTD era. She ended up performing a concert later this day (I attended it and it was the day I finally met Lana yay) but by that time her hair had fallen a bit and she changed into one of her infamous black shirts lol. So the look from earlier in the day wins!
     
     
     
    11. April 30 - Candid at a Beach House in Malibu
    Similar to the look above, I saw this post on instagram and thought it was a throwback post from around September 2014. I'm serious. Then when everyone started posting it, I realised it was from that day. I was shaken to the core. Even though it's a natural look, she looked amazing.
     
     
     
    12. June 30 - Hollywood Roosevelt Hotel
    This reminded me so much of her 2011 Grasslands performance look, and I loved the throwback. (as you can tell, I love throwback looks.)
     
     
     
    13. March 16 - Candid on a Beach in Malibu
    This was another day full of iconic candids paired with an iconic look. Her dress was super cute and her hair looked nice too.
     
     
     
    14. May 9 - Elle Magazine
    Again, the date is incorrect, but I just put the date of the first time this shoot was spoken of. She looked really gorgeous during this shoot. The photo I'm putting in the spoiler is one of my favourite photos of the year.
     
     
     
    15. November 14 - Manager Awards
    This look reminded me so much of her 2013 Brit Awards look. The dress was perfect for her and her hair was styled beautifully. I prefer this look to the EMA look, which was the day before. 
     
     
     
    16. March 20 - Instagram
    I was instantly hit with April 2014 nostalgia when I saw this instagram post. From her hair to her makeup, she looked straight out of the Ultraviolence era. Also, this is when she first teased Yosemite with her shirt... iconic.
     
     
     
    17. August 19 - Krakow Live Festival
    This dress!! Omg!! I also snagged this dress for myself. It's super cute. I also liked how she styled her hair this day, it was so unique. Even though the eyeliner was an interesting choice, she still pulled it off well.
     
     
     
    18. April 6 - Flaunt Magazine
    I'm so sad this is the only photo we have of this look, because it looks amazing. I can imagine that professional photos would make it even more amazing. Lana as a bride? Can we get any more iconic here??

    This has got to be one of her best selfies of 2017. I've always thought that light pinks look beautiful on her.
     
     
     
    20. - October 23 - Terminal 5 NYC
    When I saw her step out on stage this night, I was shaken. Again, despite the same black&jeans look, this was another one that was styled nicely. The top was really cute & different from what she had been wearing. I really liked the neckline. Her jewelry was also gorgeous.. that choker though!! Wow! I also appreciated the volume in her hair after the big chop.
     
     
     
    21. January 28 - Candid in LA
    This was the first look to leave me shaken in 2017. Her hair. Enough said.

    She looked so sweet on this day. I wish we had photos from it. Whatever top or dress she's wearing looks adorable & I love the way her hair is styled.

    Her dress paired with that sweater is just precious. & her hair was a nice change this night.
     
     
     
    24. September 11 - Hollywood Troubadour 
    Another natural, yet gorgeous look. Her makeup was simple, yet gorgeous. Also... teasing us with that LFL windbreaker before we even knew what it was!
     
     
     
    25. July 22 - Airport in France
    Who else could make walking in an airport look like a runway? Yes, the outfit is tired, but her makeup was amazing this day.

    I inadvertently ended 2017 with Resistance (not a bad choice, though), and began 2018 with Love, which just seemed to really fit -- and I see some of you thought the same! <3
     
    Here's hoping 2018 is a year of love for us all -- love for one another, love for life, love for the world, true love, and love for our humanity. We need it more than ever, and I think we have the power to make it a beautiful, happy year.

    The last Lana song I listened to in 2017 was Salvatore. My concert date is in 12 days so I'm gonna not listen to her at all this week, then listen to her every day leading up to the concert to get hype!
